Acceptable Use Policy
Introduction
DCLLABS.net does not actively monitor nor exercise editorial
control over the content of any Web site, electronic mail
transmission, mailing list, news group or other material
created or accessible over the DCLLABS.net network. However,
DCLLABS.net reserves the right to remove any materials that, in
DCLLABS.net's sole discretion, are potentially illegal, may
subject DCLLABS.net to liability, or violate this Acceptable Use
Policy ("AUP"). Violation of this Policy may result in the suspension
or cancellation of your services, to be determined in the sole
discretion of DCLLABS.net. DCLLABS.net also reserves the right to
cooperate with legal authorities and/or injured third parties in the
investigation of any suspected crime or civil wrong.
Policies
Violations or Articles of the AUP (Acceptable Use Policy) for DCLLABS.net:
- Exporting software or technical information in violation of U.S export
control laws.
- Any 'e-mail' user account exceeding 15MB. Any transmissions to a mailbox
that is near or at capacity of 15Mb could be refused. Clients must maintain
sufficient free space in their mailbox to handle incoming traffic. Additional
capacity is available for purchase. Webmail is to be used as a
convenience only. Large amounts of e-mail should be downloaded to your e-mail
client and are not expected to stay on our servers. We are not set up to keep
large amounts of e-mail on our servers. Anyone doing so, gives DCLLABS.Net the
right to delete excessive e-mail to keep from locking up their e-mail account
and storing large amounts of e-mail on our systems. If such cases are suspected,
we will warn users via e-mail in advance. If the account user continues to abuse
this privilege, account e-mail boxes could be locked.
- Revealing your account password to others or allowing use of your
account by others (other than authorized users in your household).
- Knowingly continuing to send or distribute any type of virus, worm
or trojan to or from DCLLABS.net systems especially after being notified
of such problems by the Administrator of DCLLABS.net. Cancellation time
can be deemed solely by the Systems Administrator.
- Unauthorized copying of copyrighted material including, but not limited to,
digitization and distribution of photographs from magazines, books, or other
copyrighted sources, and copyrighted software.
- Posting or e-mailing of scams such as 'make-money-fast' schemes,
'pyramid or chain' letters, whether private, commercial or political
in nature. Immediate suspension can occur for this violation.
The sending e-mail address could be automatically blocked from DCLLabs.net.
- Threatening bodily harm or property damage to individuals or groups.
- Harassment, hate crimes, "hateful messages" or messages containing
derogatory comments or statements about a person or group because of their
race, gender, or religious beliefs.
- Making fraudulent offers of products, items, or services originating from
your account.
- Attempting to access the accounts of others, or attempting to penetrate
security measures of 'DCLLABS.net or other entities and systems' ("hacking
or port scanning"), whether or not the intrusion results in corruption or
loss of data.
- The unauthorized use of a person's name or likeness.
- Harassing others by 'mail-bombing' or 'news-bombing'. 'Mail-bombing'
constitutes sending more then ten (10) similar mail messages to the same
e-mail address. 'News bombing' constitutes cross posting to more than 10
different newsgroups.
- At no time can there be simultaneous use of the same username and password
combination without prior authorization .
- Forging any message header, in part or whole, of any electronic
transmission, originating or passing through the DCLLABS.net services.
- Sending more than (5) names in the (To: or Cc:) field of any e-mail
client, or forwarding an e-mail exceeding the limit in these fields.
If more than (5) names, please use the Bcc: (Blind Carbon Copy) field instead.
We use this policy to cut down on servers acquiring e-mail names for large
Bulk Mail or SPAM. This also applies to all Sub Domains that live here at
DCLLABS.net.
- Anyone sending to DCLLABS.net violating this policy, could be blocked
from DCLLabs.net systems and Sub Domains.
- Anyone sending more than (35) names in the (To:) or (Cc:) Field is
automatically blocked and could never regain access.
- Anyone attempting to send or relay unauthorized mail from this domain
or any Sub Domains that live at DCLLABS.net will automatically be blocked and
could never regain access.
- Use of software or any device that would allow your account to stay
logged on while you are not actively using the DCLLABS.net services
or use the account for the purpose of operating a server of any type, unless
given authorized permission.
- Installation of 'auto-responders', 'cancel-bots' or similar automated or
manual routines which generate excessive amounts of net traffic, e-mail or disrupt
net newsgroups by others.
- Engaging in 'spamming', as that term is commonly understood in the
industry, or as that term is defined in any federal, state, or local
regulation or legislation.
Unlimited Service
You acknowledge that DCLLABS.net's service is intended for
periodic, active use of e-mail, user newsgroups, file transfers
via FTP and browsing the World Wide Web. You further agree not
to use the service as a dedicated connection, or a connection
that is actively or inactively in use for 24 hours a day.
DCLLABS.net reserves the right to monitor any heavily active or
inactive account, and reserves the right to terminate any connection
that is inactive for more than thirty (45) minutes or for a session
lasting longer than six (18) continuous hours. The DCLLABS.net
FTP Servers will automatically terminate inactive sessions after
(8) minutes. DCLLABS.net also reserves the right to suspend, cancel,
or upgrade an "unlimited service" account to a "dedicated connection"
account in the event the Customer or User is using the service as a
dedicated connection. The use of pinging, or any other technologies
that mimic an activity or "dedicated connection" is expressly prohibited.
Unsolicited Electronic Mail
Sending unsolicited electronic mail (e-mail) messages where the
recipient objects to the content of the message or to the receipt of
the message in general is also prohibited under this Acceptable
Use Policy. You acknowledge that you are expressly prohibited
from utilizing DCLLABS.nets' service, DCLLABS.nets' equipment or
DCLLABS.nets' e-mail addresses in connection with the sending of the
same or substantially similar unsolicited e-mail message, whether
commercial or not, to a large number of recipients. This prohibition
extends to the sending of unsolicited mass mailings from another
service which in any way implicates the use of DCLLABS.nets' service,
DCLLABS.nets' equipment or any DCLLABS.nets' e-mail address(es) or
IP address(es).
Unsolicited Newsgroup Postings
A message is unsolicited if it is posted in violation of a USENET
or newsgroup charter and/or if it is sent to a recipient who has not
requested or invited the message. For purposes of this provision,
merely making one's e-mail address accessible to the public shall
not constitute a request or invitation to receive messages. You
agree that you will not utilize the DCLLABS.nets' equipment or any
DCLLABS.nets' e-mail address in connection with the transmission
of the same or substantially similar unsolicited message to 10 or
more recipients, or 10 or more newsgroups in a single day. For each
day upon which this provision is violated, you agree to pay $50.00
per day for an unintentional violation of this provision, but where
warranted, such as in the case of an accidental transmission. In
cases of willful violations of this provision, you agree to pay
DCLLABS.net up to $1,000.00 per day. You agree that DCLLABS.net,
at its sole discretion, shall determine whether such a violation was
unintentional or willful. Payment by member under this provision
shall not prevent DCLLABS.net from canceling the DCLLABS.net Service
in its sole discretion, or seeking to obtain any other legal remedies
against member, including monetary damages or injunctive relief or any
other remedy provided by law. Subscriber agrees to pay any legal, or
other fees, incurred by DCLLABS.net in pursuing such legal remedies,
in the event DCLLABS.net prevails on any material issue or claim
brought as a result of the above described activity.
